Subject:  Information according to art. 13 of the EU Reg. GDPR 679/2016 and subsequent amendments

1. THE "DATA CONTROLLER”

Following consultation of this site, data relating to identified or identifiable persons may be processed.

According to art. 4, paragraph 1, n.7 of the Regulation (EU), the Data Controller is LEXIS RICERCHE S.R.L., in the person of the pro-tempore Legal Representative, at Corso Italia n. 49 - 20122 Milan.

 

2. PLACE OF DATA PROCESSING

The data processing connected to the web services of this site take place at the operational headquarters of the Organization in Corso Italia n. 49 in Milan. The data processing is carried out by internal staff, appointed and trained on the security and confidentiality of personal data.

The data will be stored in the Data Controller (email) database, without any transfer of data to unauthorized third parties.

 

3. PURPOSE OF THE  DATA PROCESSING 

The personal data provided by the interested parties will be processed directly for the following purposes:

• Provide answers and information following user requests;

• Prepare a quotation at the user's request;

• Statistical purposes in anonymous and aggregate form.

 

4. DATA PROVIDED VOLUNTARILY BY THE USER

The explicit and voluntary provision of personal data by the User is necessary for the provision of the service. All this involves the acquisition of the email address, as well as any other personal data, necessary for the forwarding of communications relating to the services offered. The provision of personal data is free and optional. Failure to provide the data will make it impossible to proceed with your requests.

 

5. METHOD OF DATA PROCESSING

The processing will be carried out with the use of electronic tools by specially appointed personnel. In relation to your personal data, all the appropriate tools will be adopted to guarantee their security and confidentiality, in compliance with the provisions of the Regulations. In particular, all technical, IT, organizational, logistical and procedural security measures will be adopted, so that the minimum level of data protection required by current legislation is guaranteed.

 

6. DATA COMMUNICATION 

Personal data may be disclosed to employees and internal collaborators of the Organization.

The personal data collected to achieve the purposes indicated may be disclosed, to the extent of their specific competence, to third parties that the Data Controller uses, such as, by way of example, the following categories:

• Subjects that provide services for the management of the computer system that supports the website;

• Subjects who provide or develop programs and applications for the Organization.

 

7. DURATION OF THE DATA PROCESSING

The duration of this data processing is established for a period of time not exceeding the achievement of the purposes for which they were collected.

 

8. RIGHTS OF THE INTERESTED PARTIES

Within the limits and under the conditions set out in Articles 15 - 23 of the Regulations, the Organization guarantees and recognizes the exercise of the following rights:

• the right to access personal data in their paper and / or electronic archives;

• the right to request rectification, updating and cancellation, if incomplete or incorrect, as well as to oppose their processing for legitimate and specific reasons;

• the right to obtain the correction of inaccurate personal data without undue delay. Taking into account the purposes of the processing, the interested party has the right to obtain the integration of incomplete personal data, also by providing a supplementary declaration;

• the right to obtain the cancellation of personal data concerning him/her without undue delay if one of the reasons referred to in art. 17, paragraph 1 of the Regulations;

• to obtain the restriction of processing when one of the hypotheses referred to in art. 18, paragraph 1 of the Regulations;

• the right to data portability within the limits and in the manner provided for by art. 20 of the Regulation.

You also have, at any time, the right to withdraw consent to the processing of your data without prejudice in any way to the lawfulness of the processing based on the consent given prior to the revocation.

You have the right to receive information relating to the action taken regarding one of the aforementioned requests or the effects arising from the exercise of one of the aforementioned rights, without undue delay and, in any case, at the latest within one month of receipt of the request; you also has the right to lodge a complaint with a supervisory authority and to lodge a judicial appeal.

Without prejudice to the case in which the processing of data violates the general principles dictated by the Regulation, the exercise of these rights must be relevant and motivated and may not imply the revocation of the consent given or the request for cancellation of the data provided for the conclusion and the execution of the contract, insofar as and as long as the data are necessary for this purpose.

Types of Data Processed

These are personal data capable of identifying the User through the indication of information such as the company name and VAT number, first and last name, tax code, address, email address, fax, website, and date of birth, telephone or mobile number for individuals, and information provided during registration and unique IDs used by advertising services like (e.g., Google Ads).


 

Data Acquired During Site Navigation


 

The computer tools used to ensure the proper functioning of the Site acquire some Personal Data that are automatically processed during the use of standard Internet protocols. Although the information acquired during navigation is not collected with the intention of being associated with specifically identified individuals, it could allow the identification of users following association with other data held by third parties.


 

List of Navigation Data


 

IP addresses or domain names of computers used by users who connect to the Site; the addresses in URI (Uniform Resource Identifier) notation of the requested resources, the time of the request, the method used to submit the request to the server, the numerical code indicating the status of the response from the server (successful operation, error, etc.), the size of the file obtained in response, and other parameters related to the operating system. All these data are used solely for the purpose of obtaining anonymous statistical information about the use of the Site, to monitor its proper functioning, and to detect any anomalies and/or non-conforming uses. The data acquired for these purposes are deleted immediately after their processing. Moreover, the data could also be used to ascertain responsibility in the event of computer crimes against the site or third parties. Some sections and features of the Site designed for the acquisition of the User's Personal Data may require the release of Personal Data related to the categories mentioned in Article 9 of the Regulation, namely “[…] data suitable to reveal racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as process genetic data, biometric data intended to uniquely identify a natural person, data concerning health or sexual life or sexual orientation of the person.” The LEXIS RICERCHE S.r.l. advises its users not to publish such data unless strictly necessary. However, should a User choose to publish highly personal information, even without a specific manifestation of consent to process such data, it absolves LEXIS RICERCHE S.r.l. of any responsibility, which cannot be exposed to disputes of any kind because, in such cases, the processing of the data must be considered authorized following the free and informed choice of the interested party to make them manifestly public in compliance with the provision contained in Article 9(1)(e) of the Regulation.

General Premises and Definition


 

Cookies are metadata files that are stored on the devices used by users to navigate the Site. These files are sent from the Site and are recorded on the computer or mobile device used by the User in order to be retransmitted to the same Sites during a possible subsequent visit. Thus, cookies allow the Site to store the actions and preferences of the user (such as login data, chosen language, font sizes, other display settings, etc.) and eliminate the need to re-enter the data previously provided by the User during each visit to the Site. The use of temporary cookies is limited to providing safe and efficient navigation on the Site, as well as to identify the User in order to ensure the correct delivery of the service requested on this Site. For the correct functioning of the website, the User is required to enter all the personal information requested. For this type of cookie, prior consent from the User is required. Current legislation in Italy does not always require the user's express consent to allow the Site owner to use cookies. "Technical cookies," for example, do not require such consent as they are indispensable files for the correct functioning of the Site and are used solely to ensure the correct delivery of a service expressly requested by the User. These are necessary cookies that must be installed on the User’s device to ensure the completion of certain operations.
